Driver may be blamed in passenger death due to car accident

Dec 07, 2020 | Personal Injury

When a car crash takes a life, it is a tragedy in any circumstance. Many North Carolina families know this pain all too well after losing loved ones due to someone else’s careless mistake. One recent fatal car accident is currently under investigation as police work to determine whether the driver was at fault for the death of his passenger.

Official reports say that the crash happened on a recent early morning weekday. One vehicle was headed east on a state highway. Officers claim the vehicle was excessively speeding and veered off the right side of the highway for an unknown reason. Officers say that at that point, the vehicle swerved back onto the road and ended up running off the road on the left side. It apparently ran into a ditch where it turned over.

Though police say that the passenger in the vehicle was wearing a seat belt, she died as a result of her injuries. The driver was not using a seat belt and had to be rushed to a nearby hospital via helicopter for treatment. Though there is no word on his current condition, officials say that they intend to press criminal charges against the driver. Police say they have not ruled out the possibility of the driver being intoxicated and are awaiting further investigation results.

Though the woman who died was a passenger in the vehicle, her family could still choose to take legal action against the driver. No matter what happens with any criminal charges the driver may face, the family could file a wrongful death lawsuit against him here in North Carolina. If they did, monetary damages may be the result, which may be helpful as they attempt to cover unexpected costs related to the car accident. Anyone in a similar situation may want to reach out to a wrongful death attorney to discuss available options.
